Registration Procedure for Obtaining Work Permit for Foreign Citizens Having a Visa
Required Sets of Documents
It is necessary to prepare 2 sets of documents:
- for registration of work permitand use of foreign employees;
- for registration of work permitfor a foreign citizen or a stateless person.
The set of documents required for registration of work permitand use of foreign employees:
- Application written to the name of Vice Director of Russian Federal Migration Service and its copy claiming to grant the employer or contractor (of work or services) with a permit to employ or use foreign citizens.
- Resolution of the executive body of the Russian Federation responsible for matters of employment in appropriate territorial subject of the Russian Federation. In case of employment and use of foreign citizens:
- Ministry resolution should be granted to an organization within the jurisdiction of Ministry of Defense of the Russian Federation.
- Resolution of Federal Marine and River Transport Agency, Ministry of Transport and Communications of the Russian Federation and Federal Agency for Fishery of Ministry of Agriculture of the Russian Federation to be employed as a crew member of Russian sea-craft and fishing vessels.
- Draft labor contract or other documents confirming preliminary agreement with foreign citizens or foreign partners about intention and terms of employment of foreign employees.
- Terms of payment and protection of labor of foreign employees, their welfare and insurance are determined by legislation of the Russian Federation with account of features provided by international agreement of the Russian Federation.
- Original document stating payment of the state duty for issuing the permit to the employer or contractor (of work or services); for every employed foreign citizen under the quota it is necessary to pay 3,000 roubles.

· a copy of the certificate issued after registration in Unified State Registry of Sole Traders
· a copy of the identity card stating the place of registration of the sole trader
· a copy of the certificate issued after registration with tax authority at place of residence

If copies of the documents are presented without originals, they must be notarized.
Procedure of Obtaining Work Permit for Foreign Citizens Who do not Have a Visa
Set of Required Documents
It is necessary to prepare the following documents:
- Application for a work permit to (its front and reverse sides) for a foreign citizen arriving in the Russian Federation without obtaining a visa and its copy.
- The identity card of a foreign citizen recognized in the Russian Federation.
- Migration card.
- Document stating payment of 2,000 roubles state duty for issuing the work permit to a foreign citizen.
- The application form should be filled in in block letters or in electronic form in Russian; clipped words and abbreviations are not accepted. The data specified in the application must be comprehensive. A colour photograph sized 30x40 millimeters should be stuck in the appropriate place of the application form.
Submission of the Set of Documents
A foreign citizen who arrived in the Russian Federation without obtaining a visa should submit an application to get a work permit and all necessary papers specified in List of Required Documents to the agency of migration service. Each applicant should do it by him/herself or via an organization employing foreign citizens in compliance with the existing regulations, or via the person acting as a representative of the foreign citizen according to the civil legislation of the Russian Federation.
The term of registration of a work permit for a foreign citizen arriving in the Russian Federation without obtaining a visa is 10 working days.
Obtaining a Work Permit
A work permit is granted to a foreign citizen personally upon presenting his identity card recognized in the Russian Federation.
A foreign citizen who arrived in the Russian Federation without obtaining a visa and who obtained a work permit should:
- work only in the territorial subject of the Russian Federation specified in the work permit;
- within 30 days of the date of obtaining the work permit, present to the agency of migration service, which provided him/her with a work permit, documents stating that he/she is not drug addicted and does not have dangerous infectious diseases specified in the list issued by Government of the Russian Federation (leprosy or Hansen’s disease, tuberculosis, syphilis, chlamydial lymphagranuloma, chancroid), and also a certificate stating that he/she does not have diseases initiated by human immunodeficiency virus (HIV infections) if the work permit is granted to a foreign citizen for a term of more than 90 days.
When trying to obtain permit to work in Moscow, it is requested to submit a medical certificate in the established standard form. In case the above medical document is not presented in due time, the work permit issued to a foreign citizen is subject for annulment.
Procedures for Employers to Notify Authorities of Employment of Foreign Citizens Who Arrived in the Russian Federation without Obtaining a Visa
Employer who made a labour or civil-law contract with a foreign citizen who arrived in the Russian Federation without obtaining a visa should notify a local department of Russian Federal Migration Service (FMS) and the executive body responsible for employment in a corresponding subject of the Russian Federation about employment and use of foreign citizens who arrived in the Russian Federation without obtaining a visa within 3 working days of the date of signing the contract.
The notice consists of two parts. The first part is filled in by the employer in 1 copy strictly according to the order specified therein; the second one is for every employed foreign employee who arrived in the Russian Federation without obtaining a visa and with whom the employer made a labour or a civil-law contract.
A record on the detachable part of the notice form of corresponding bodies or a postal notification sent via federal mail service organization is a confirmation of execution of the duty to notify the local department of Federal Migration Service.
Set of Documents Required for Obtaining a Work Permit for a Foreign Citizen or an Apatride:
- An application and its copy to obtain a work permit for every foreign citizen or an apartride arriving in the Russian Federation with obtaining a visa. The application form is filled in in Russian in block letters or in electronic format, clipped words or abbreviations are not accepted. The application data should be comprehensive.
- One colour photograph sized 30x40 millimeters of the foreign citizen which should be stuck in the corresponding place of the application form.
- A copy of the document of professional education, qualification of the foreign employee in a foreign state or a certificate stating equivalence of such a document to a Russian diploma (certificate) of professional education.
- A copy of identity card of the foreign employee (valid not less than 6 months).
- A copy of the permit to employ and use foreign employees.
- A letter of guarantee of the employer providing a departure of the foreign employee from the Russian Federation at first notice done by Federal Migration Service of the Russian Federation.
- Original of the payment document of state duty payment for obtaining a work permit; 1,000 roubles should be paid for every foreign employee.
Official documents signed in a foreign state copies of which are presented to obtain a work permit by a foreign citizen must be duly legalized in diplomatic missions or consulates of the Russian Federation abroad unless other actions are foreseen under international contracts of the Russian Federation.
In case the documents are drawn in a foreign language, they should have notarized translation into Russian. If copies of the documents are presented without their originals, they also must be notarized.
Presenting Applications
Applications to obtain a permit to employ and use foreign employees, applications to obtain a work permit for a foreign citizen who arrived in the Russian Federation with a visa and all required documents specified in corresponding lists are presented by an authorized representative of the organization employing foreign citizens per procurationem. The term of official registration of the work permit for a foreign citizen who arrived in the Russian Federation with a visa is 30 days.
Obtaining Permits
It is necessary to have the passport and a warrant from the organization to obtain permits in Russian Federal Migration Service.
To obtain complete work permits it is necessary to submit:
- the certificate stating that the foreign citizen does not have a disease caused by human immunodeficiency virus (HIV infection);
- the certificate stating that the person is not drug addicted and does not have dangerous contagious diseases subject to rejection of the work permit in the Russian Federation: leprosy or Hansen’s disease, tuberculosis, syphilis, chlamydial lymphagranuloma, chancroid.
When obtaining permits to work in Moscow, it is necessary to submit medical certificates in only the established standard form.
